01Who We Are
ClearPath Investments ("Clear Path Investments," "we," "us," or "our") is a real estate direct cash home buying business. We purchase real estate directly from homeowners as a principal buyer — meaning we are the actual buyer, not a middleman acting on someone else's behalf.
02What Direct Home Buying Means
As a direct home buyer, we enter into a purchase contract with you — the homeowner — and we are the buyer. We may close in our own name, in the name of an affiliated LLC or trust, or we may, in some transactions, transfer our interest in the contract to an affiliated end buyer prior to closing. In all cases, title transfers through a licensed title company and you receive the agreed cash at closing.
This is entirely different from working with a real estate agent or broker. We are a principal in the transaction — we have a real, written, signed contract to purchase your property, and we intend to close on it.
03Our Home Buyer Disclosure
You will be informed of the nature of the transaction in the written purchase agreement before you sign anything. By executing that agreement, you acknowledge and consent to its terms, including the identity of the closing party.
04How We Make Our Offer
Our cash offers are based on a number of factors, including but not limited to:
- The estimated after-repair value (ARV) of the property based on comparable sales.
- The estimated cost of any repairs, renovations, or improvements needed.
- Current market conditions and demand in the property's submarket.
- Holding costs (taxes, insurance, utilities, financing) during the period an end buyer or our own team would own the property.
- Closing costs and transaction expenses.
- A reasonable profit margin sufficient to compensate the investor or end buyer for risk and effort.
Because our offers must allow for repair costs, holding costs, and investor profit, they are typically below retail market value. In exchange, we offer speed, certainty, no commissions, no repairs, and no contingencies — benefits that may outweigh a higher listed price for many sellers in particular situations.
05Your Right to Other Options
You are under no obligation to accept any offer from Clear Path Investments. We strongly encourage you to consider all of your options before signing any agreement, including:
- Listing the property with a licensed real estate agent.
- Selling for-sale-by-owner (FSBO).
- Obtaining offers from other cash buyers or investors.
- Holding the property and renting it.
- Consulting with an attorney, tax advisor, or trusted financial professional.
We will never pressure you to sign a contract. If our offer is not the right fit, that's perfectly fine.
06No Brokerage Services
Because we are not a brokerage, we do not provide the services a licensed real estate agent or broker would provide, including but not limited to:
- Listing the property on the MLS.
- Representing your interests as a fiduciary or providing brokerage advice.
- Marketing the property to retail buyers on your behalf.
- Negotiating on your behalf with other parties.
- Conducting open houses or coordinating retail showings.
Where required by applicable state or local law, we will provide additional disclosures and comply with all applicable rules governing direct home buyers and real estate investors in that jurisdiction.
07No Guarantee of Profit, Leads, Deals, or Closings
This applies equally to property sellers, investor partners, joint venture participants, end-buyer customers, referral partners, and anyone else engaging with our business in any capacity.
08Title, Escrow & Closing
All transactions are closed through a licensed title company, escrow agent, or closing attorney as appropriate to the jurisdiction. This third-party closing professional handles funds, prepares the deed and other closing documents, and ensures compliance with applicable state and federal closing requirements.
Clear Path Investments does not hold seller funds in trust or escrow. Earnest money, when required by contract, is held by an independent escrow agent or title company.
09Marketing Methods
To generate seller leads and identify investment opportunities, Clear Path Investments may use marketing channels including but not limited to: direct mail, online advertising, social media advertising, search engine optimization, search engine marketing, cold calling (in compliance with applicable Do Not Call regulations), SMS messaging (with required opt-in consent), email outreach, signage, referrals, and partnerships with other investors or service providers.
All marketing efforts are intended to operate within applicable federal, state, and local laws, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, state-level Do Not Call and consumer protection laws, fair-housing laws, and applicable advertising regulations.
10Acknowledgment
By using our website or engaging in any communication with ClearPath Investments, you acknowledge that you have read, understood, and accept this Home Buyer Disclosure. You acknowledge that we are not a brokerage, that our offers are non-binding until reduced to a fully executed written purchase agreement, and that we operate as a direct cash home buyer as described in this disclosure and in any signed purchase agreement.
